1. Introduction

99 Bays LLC (“99 Bays,” “we,” “our,” or “us”) respects your privacy and handles personal information responsibly. This policy explains how we handle information about visitors to 99bays.com, people who contact us and those enquiring about our services.

Our website presents professional website services, brand identity, website improvements and website care. This policy also covers related business communications.

2. Information we collect

You may provide your name, email address, optional company name, selected enquiry type and a description of your project or requirements. We also receive information you provide in subsequent business communications. Enquiry notifications include the source page and a submission reference.

Technical and security information may include IP addresses, browser and device information, pages requested and activity associated with protecting the website. Our spam-prevention safeguards use pseudonymous identifiers, including a hashed IP identifier for rate limiting; pseudonymous information is not necessarily anonymous.

Please do not submit passwords, payment card information or sensitive shipment documents through our enquiry forms.

3. How we use information

We use information to respond to enquiries, understand requirements, prepare proposals, coordinate and deliver agreed services, support clients, maintain website security, prevent spam and abuse, maintain necessary business records and comply with applicable obligations.

The lawful grounds for processing depend on the applicable law and circumstances. Where relevant, these may include taking steps at your request before a contract, performing a contract, legitimate interests in responding to business enquiries and protecting the website, complying with legal obligations, or consent where required. Where we rely on consent, you may withdraw it without affecting the lawfulness of earlier processing.

We do not sell personal information.

4. Sharing and service providers

We use service providers to operate the website and handle communications:

  • Namecheap provides website hosting and infrastructure.
  • Cloudflare Turnstile provides security checks and spam prevention. Cloudflare also processes security signals to improve Turnstile’s bot detection. See Cloudflare’s Turnstile Privacy Addendum.
  • Resend delivers enquiry notifications.
  • Microsoft 365 supports business email and communications.

These providers process information needed to perform their functions, such as hosting requests, assessing security activity or delivering and storing business email, under the applicable service arrangements and privacy terms. Enquiry notifications are sent to our business mailbox; your email address is used as the reply address so we can respond to you.

We may disclose information where required by law or where reasonably necessary to protect rights, investigate abuse or obtain professional advice, subject to applicable law. We do not disclose your personal information to third parties for their independent marketing.

5. Cookies and similar technologies

The website uses functionality and security technologies needed to operate the site and protect enquiries. A limited browser-storage preference can remember whether you want the Turnstile spam check to ask before loading, load automatically or remain unloaded so you can contact us by email instead.

If saved, this preference contains the selected mode and an expiry, rather than your enquiry contents. It is set to expire after 90 days and is removed when next read after expiry. You can change or forget the saved choice through Cookies & Preferences. Changing a preference cannot undo information already sent to a provider.

Turnstile may process browser, device and connection signals when it loads. Valid verification is required to submit an enquiry form; email remains available if you choose not to load it. Hosting and security providers may use their own cookies or similar technologies.

Our website implementation does not include optional analytics or advertising trackers. See Cookies & Preferences for more information and preference controls.

6. Data retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including handling enquiries, managing business relationships, maintaining necessary records, resolving disputes and meeting applicable legal obligations.

Retention depends on the information type, the relationship and actual hosting, security and email-provider settings. Enquiries may remain in business correspondence and provider systems, and security records are managed separately. We do not promise a single fixed deletion period for all information.

When information is no longer needed, we take reasonable steps to delete, anonymize or securely dispose of it, taking account of applicable obligations, backup cycles and provider capabilities. You can contact us about the retention of your information or request deletion where applicable.

7. Data security

We use reasonable technical and organizational safeguards appropriate to the information and risks involved. Website safeguards include HTTPS, server-side validation, spam verification and rate limiting. Application secrets are kept in private configuration outside the public website directory, and access to business information is restricted to authorized use.

No method of transmission or storage is completely secure. We cannot guarantee absolute security, and you should avoid sending sensitive information through website enquiry forms.

8. International data processing

Our technology providers may process or store information in multiple countries. The protections available under local laws may differ from those in your country.

Where applicable law requires safeguards for an international transfer, those requirements must be addressed through the relevant provider arrangements and legally available transfer mechanisms. This policy does not represent that all information remains in a single country or that a particular transfer mechanism applies to every provider or request.

9. Privacy rights

Depending on applicable law and your circumstances, you may have rights to access your personal information, correct inaccurate information, request deletion, restrict processing, object to certain processing, receive a portable copy of information or withdraw consent where processing relies on consent. These rights may be subject to exceptions and legal requirements.

Send requests to hello@99bays.com. We may ask for information reasonably needed to verify your identity and understand the request. We respond in accordance with applicable legal requirements. Where applicable, you may also complain to the relevant data-protection authority.

10. Third-party websites

Our website may link to external websites. Those websites have their own privacy practices and terms. Review their policies before providing information to them; this policy does not govern their independent activities.

11. Children’s privacy

Our website and services are intended for professional and business audiences, not children. We do not knowingly seek personal information from children. If you believe a child has provided personal information to us, contact us so we can assess the situation and take appropriate steps.

12. Changes to this policy

We may update this policy to reflect changes to our website, practices or applicable requirements. The updated version will be published here with a revised effective date. Where required, we will provide additional notice of material changes.
